Steps for pedestrians to take when hit by an Uber

When you are a pedestrian, you need to watch out for all cars, including Ubers and Lyfts.

In the event an Uber driver hits you, then you initially need to follow the same basic steps as if any other vehicle struck you. 

Get to safety

When you are in the middle of the street, you need to try to get back to the sidewalk if possible to get out of harm’s way. You need to contact the police immediately, so they can create a full report. You also want to exchange information with the Uber driver. While you wait for the police, you need to gather as much evidence as you can, such as taking pictures of the vehicle. If you are unable to do it, then get someone nearby to assist you. 

Learn what period the driver was in

One contentious issue with the company is that the drivers are not employees. They are independent contractors. As a result, there are certain periods of time where they are not on the clock. For example, if the driver did not have a passenger in the vehicle and looked for fares at the time of the collision, then Uber will likely not be liable. However, if a passenger was in the vehicle, then the driver should have coverage through the company’s liability insurance

Consult with an attorney

Car accident cases can become surprisingly complex, especially when a company like Lyft or Uber becomes involved. After you see a doctor, you need to get in touch with a lawyer to figure out what your next steps should be. You do not have to talk to the other driver’s insurance agency or Uber’s insurance without an attorney present.
